Big Changes Ahead: Queensland’s New Property Laws Start August 1st

From August 1, some big changes are coming to the way property is bought and sold in Queensland, thanks to the introduction of the Property Law Act 2023.

One of the biggest updates is a shift away from the old “buyer beware” model. Sellers will now need to provide more detailed information about a property before a contract is signed - making the process clearer and fairer for everyone involved.

What’s Changing for Sellers?

Right now, sellers are only required to provide a few key things:

  • A pool safety certificate (or a notice of no certificate)
  • Smoke alarm compliance
  • Body corporate disclosure (for strata properties)
  • Basic warning statements in the contract

But from 1 August, sellers must provide:

  • A completed Seller Disclosure Statement (Form 2)
  • A set of prescribed documents, including:
    • Title and plan details (like a current title search)
    • Details of any easements, covenants, leases, or encumbrances
    • Zoning and planning info, including any notices
    • Environmental or safety compliance (e.g. pool safety, environmental protection)
    • For strata properties: Community Management Statement and Body Corporate Certificate

Why This Matters?

If these documents aren’t provided correctly before a buyer signs the contract, the buyer could legally terminate the agreement any time before settlement, even just days before the deal is meant to go through.

These changes are all about protecting buyers and giving everyone more clarity and confidence in the process, while also helping to avoid last-minute surprises or disputes.
